Terms of Service

1. Acceptance of Terms

By accessing or using Loomaris at app.loomaris.xyz or any associated service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

The Service is operated by Avnish Kumar ("Loomaris", "we", "us", "our"), an individual developer based in Pune, Maharashtra, India.

2. Description of Service

Loomaris is an AI-powered application generation platform that allows users to describe software in natural language and receive production-ready code, which can be deployed to the user's own cloud infrastructure. The Service uses Anthropic's Claude AI models to generate code and related assets.

The Service is currently in an early-access phase. Features, availability, and pricing are subject to change with reasonable notice.

3. Account Registration

To use the Service, you must sign in using a valid Google account. By doing so, you represent that:

• You are at least 13 years old
• The information you provide is accurate and up to date
• You are responsible for maintaining the security of your account
• You will promptly notify us of any unauthorised use of your account

4. Your API Key

The Service requires you to provide your own Anthropic API key to generate code. By providing your API key, you acknowledge that:

• API usage is billed directly to your Anthropic account at their published rates
• You are responsible for all costs incurred through your API key via the Service
• You must not share an API key that belongs to another person or organisation without their authorisation
• We store your API key encrypted at rest and use it only to fulfil your requests

5. Acceptable Use

You agree not to use the Service to:

• Generate malware, ransomware, spyware, or any software intended to cause harm
• Create applications that violate any applicable law or regulation
• Attempt to reverse-engineer, scrape, or abuse the platform's API
• Generate, store, or deploy content that is illegal, defamatory, or infringes third-party rights
• Circumvent or attempt to circumvent usage limits, authentication, or security controls
• Impersonate any person or entity
• Use the Service for any purpose prohibited under Anthropic's usage policies

We reserve the right to suspend or terminate accounts found to be in violation of these rules, with or without prior notice depending on the severity of the violation.

6. Intellectual Property

6.1 Your Generated Code

Code, files, and other outputs generated by the Service in response to your prompts are yours. You retain full ownership and may use them for any purpose, commercial or otherwise, without restriction or royalty.

6.2 Your Prompts

You own the prompts you submit. By submitting prompts, you grant us a limited, non-exclusive licence to process them solely to deliver the Service to you. We do not use your prompts or generated code to train AI models.

6.3 Platform IP

The Loomaris name, logo, interface, and underlying platform software (excluding generated outputs) remain our exclusive property. You may not copy, reproduce, or create derivative works of the platform itself.

7. Cloud Deployments

When you deploy an application to your own cloud account (AWS, Azure, GCP, or otherwise), you are solely responsible for:

• The cloud costs incurred by the deployed resources
• The security configuration of the deployed application
• Compliance with your cloud provider's terms of service
• Any data processed by the deployed application and its end users

Loomaris is a code and deployment tool. We do not operate, monitor, or take responsibility for applications after they are deployed to your infrastructure.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• Generated code will be error-free, secure, or suitable for your specific use case
• The Service will be available without interruption or delay
• Results produced by AI models will be accurate or complete

You are responsible for reviewing, testing, and validating any generated code before deploying it to production environments.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOOMARIS AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 1,000 (ONE THOUSAND INDIAN RUPEES).

10. Indemnification

You agree to indemnify and hold harmless Avnish Kumar and Loomaris from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may stop using the Service and request account deletion at any time by emailing avnish.kumar@loomaris.xyz.

We may suspend or terminate your access at our discretion if you breach these Terms, with immediate effect for serious violations (e.g., malware generation) or with 7 days' notice otherwise.

On termination, your right to use the Service ceases. You may retain any code previously generated and downloaded. Sections 6, 8, 9, 10, and 13 survive termination.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally by contacting us at avnish.kumar@loomaris.xyz.
